Form 3520 vs. FBAR Extensions: Why October 15 Is Different

October 15 can be the extended filing date for both FBAR and Form 3520, but the extension mechanisms differ. An automatic FBAR extension does not prove that a Form 3520 extension exists. Check the form, tax year, and filing evidence individually.

FBAR’s Extension Is Generally Automatic

For an ordinary annual FBAR, FinCEN provides an automatic extension from April 15 to October 15 without an extension request. See FinCEN’s due-date guidance. Confirm whether specific relief or special rules affect the particular filer.

Form 3520 Follows Different Extension Rules

For a U.S. individual using a calendar tax year, Form 3520 is generally due April 15. A granted income-tax return extension can extend its filing deadline, generally no later than October 15. Do not assume Form 3520 was extended simply because the FBAR was. Establish what income-tax extension applied and retain its evidence. Form 8938, when required, is attached to the applicable income-tax return; it should also be included in a coordinated filing review.

Two Fictional Filing Calendars

Timely Income-Tax Extension

A calendar-year U.S. individual obtains a valid income-tax extension before the ordinary deadline. The person reviews the corresponding Form 3520 deadline under its instructions and separately places the FBAR deadline on the calendar.

The dates may coincide, but the supporting evidence differs: the income-tax extension for the Form 3520 review, and FinCEN’s automatic-extension rule for the ordinary FBAR.

No Income-Tax Extension

Another calendar-year U.S. individual first seeks assistance in September and did not obtain an income-tax extension. The ordinary FBAR extension does not retroactively extend Form 3520. Investigate whether Form 3520 was required, whether another rule or relief applies, and how to address a missed deadline.

A routine Form 4868 request is generally made by the regular income-tax filing deadline. See the IRS extension guidance. Do not assume an ordinary late request cures an earlier omission.

For 2025 Reports Filed in 2026

For an ordinary annual 2025 FBAR, the automatic extended date is October 15, 2026. A calendar-year individual’s 2025 Form 3520 generally had an April 15, 2026 deadline, with a qualifying income-tax extension generally reaching October 15, 2026. These examples assume ordinary rules; verify applicable special relief and the person’s facts.

Keep the reporting year separate from the filing year in your records. Label a calendar entry “2025 FBAR filed in 2026” rather than only “2026 foreign report.” That makes it easier to match the deadline to the correct statements and filing confirmations.

Proof to Gather Before Relying on an Extension

  • Copy of the actual extension request or documentation of the applicable extension route.
  • Electronic acceptance, mailing proof, or other supporting confirmation.
  • Taxpayer name, identification details, and tax year matching the filing under review.
  • Prior filing confirmations for the information return itself.
  • Documents establishing eligibility for any special deadline relief.

A preparer’s statement that “everything was extended” should be matched to the actual filings. Note which forms are covered, which are filed separately, and who is responsible for each deadline under the engagement.
